Terms of Service

These Terms of Service ("Terms") govern your use of flatfeemlssells.com (the "Site"), operated by Pure Equity Realty, a Florida-licensed real estate brokerage (Florida Broker License #BK3276618). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Acceptance of Terms
By accessing or using the Site, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you use the Site on behalf of an entity, you represent that you have authority to bind that entity to these Terms.
2. Description of Service
Flat Fee MLS Sells is a marketing brand of Pure Equity Realty offering flat fee MLS listing services to Florida property owners. Through the Site, you can request information, submit lead forms, and learn about our pricing and service areas. Use of the Site does not by itself create a real estate brokerage relationship between you and Pure Equity Realty. A brokerage relationship is established only upon execution of a written listing agreement.
3. Real Estate Brokerage Disclosure
Pure Equity Realty is licensed by the Florida Department of Business and Professional Regulation (DBPR), Real Estate Commission. Our broker is Onias Derilus (FL Real Estate Broker License #BK3276618). License status can be verified at the Florida DBPR website (myfloridalicense.com). Real estate services are provided in accordance with Chapter 475, Florida Statutes, and the rules of the Florida Real Estate Commission.
4. The Listing Agreement Governs
If you choose to engage our flat fee MLS service, your relationship with Pure Equity Realty is governed by a written listing agreement that you sign separately. The terms of that listing agreement (including duration, fees, MLS coverage, package inclusions, and seller responsibilities) control over any general statements made on the Site, in marketing copy, or in casual communications. In the event of any conflict between these Terms or Site content and a signed listing agreement, the listing agreement controls.
5. No Real Estate, Legal, Tax, or Financial Advice
Information on the Site, including blog posts, pricing comparisons, and county and city pages, is provided for general informational purposes only. It is not real estate advice, legal advice, tax advice, or financial advice. Median home prices, MLS coverage details, closing-cost estimates, and similar figures are approximate and may not reflect current market conditions for your specific property. Consult a Florida-licensed real estate broker, a licensed attorney, or a qualified tax professional before making decisions about a real estate transaction.
6. Equal Housing Opportunity
Pure Equity Realty supports the principles of the Fair Housing Act and Florida fair housing laws. We provide real estate services without regard to race, color, religion, sex, disability, familial status, national origin, sexual orientation, gender identity, or any other classification protected by applicable federal, state, or local law.
7. User Conduct
You agree not to:
- Submit false, misleading, or fraudulent information through any Site form.
- Use the Site to transmit spam, malware, or any unlawful content.
- Attempt to gain unauthorized access to the Site or its underlying systems.
- Scrape, harvest, or systematically extract data from the Site without our prior written consent.
- Use the Site or any of its content to compete with Pure Equity Realty or to solicit our clients.
8. Intellectual Property
The Site and its content — including text, graphics, logos, photography, page layouts, and software — are the property of Pure Equity Realty or its licensors and are protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Site content without our prior written permission, except for personal, non-commercial use.
9. Third-Party Links and Services
The Site may contain links to third-party websites and services (such as the Florida MLS boards, Zillow, Realtor.com, and the Florida DBPR). We do not control these third parties and are not responsible for their content, privacy practices, or terms of service. Your use of any third-party website or service is at your own risk.
10. Disclaimers and Limitation of Liability
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Pure Equity Realty disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
To the fullest extent permitted by law, Pure Equity Realty's total liability arising out of or relating to your use of the Site shall not exceed one hundred U.S. dollars ($100). In no event shall Pure Equity Realty be liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify and hold harmless Pure Equity Realty, its agents, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to the Site or these Terms shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you submit to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
